Subdivisionand zoning ordinances are similar in that they seek to regulate <br />private use of land.Zoning regulations and subdivision regulations may both <br />impose regulations as to lot size, location and improvements.Subdivision is <br />different from the more familiar zoning in that it: <br />Typically regulates projects that are larger in scope, contemplating <br />eventual multiple owners of the newly created lots. <br />Generally is imposed at the initial development phase of a project, <br />whereas zoning is applicable through the development phase of a <br />subdivision and through the life of the completed subdivision. <br />II.Drafting a subdivision <br />ordinance <br />Subdivision regulations can only be imposed by a local ordinance adopted in <br />Minn. Stat. §§ <br />462.351 to 462.365. <br />accordance with the Municipal Planning Act. <br />A.Appropriations and expenditures <br />Cities may use any funds not dedicated by law to other purposes for funding <br />Minn. Cities may accept grants and gifts to <br />finance planning and land use activities and may contract with federal and <br />state agencies or other public and private agencies for drafting assistance. <br />B.Typical subdivisionordinance <br />provisions and concepts <br />Subdivision regulations vary widely from city to city, depending on the <br />development goals and plans of the city. For example, one city may value <br />preservation of agricultural space, while another city values the creation of <br />affordable housing. One city may prefer“cluster” developments, while <br />another prefers large single-owner,one-acre lots. These different values will <br />be reflected in the subdivision regulations the city develops. Despite this, <br />subdivision ordinances have many commonalities related to structure and <br />form.
