Streets, roads and alleys <br />Water, sewer, and similar facilities <br />Gas, electric, and similar facilities <br />Stormwater drainage and hold areas or ponds <br />Parks, recreational facilities, and playgrounds <br />Trails and sidewalks <br />Wetlands and wetland preservation <br />Open space <br />Prior to adopting dedication requirements in a subdivision ordinance, the city <br />must firstadopt a capitol improvement budget and adopt a parks and open <br />space plan.The plan may be a component ofthe city comprehensive plan. <br />When the city requires land to be dedicated within a specific subdivision, it <br />must reasonably determine that: <br />Minn. Stat. § 462.358 <br />The city reasonably needs to acquire the specific portion of land for <br />subd 2b (e); Minn. <br />reasons permitted by state statute (e.g.streets, parks, utilities) as a result <br />Stat. § 462.358 subd <br />of approval of the subdivision (this is sometimes referred to as a nexus <br />Collis v. City <br />2c (c); <br />of Bloomington <br />310 <br />requirement). <br />Minn. 5, 246 N.W.2d <br />19(Minn.1976); <br />Middlemist v. Stat. § 462.358 <br />The need created by the subdivision is roughly proportional to the city’s <br />Collis v. <br />subd 2c (c); <br />dedication requirement.
