CASE

ADOPT ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENTS IN
PARK 67 INDUSTRIAL PARK; CASE OF CAMAS MINNESOTA, INC.
By: Zoning Administrator Sylvia Frolik

Background:

The City received an application from CAMAS Minnesota, Inc. to vacate certain drainage and
utility easements on the site formerly occupied by Bjorklund Ready Mix at 6100 Industry
Avenue N.W. The site recently expanded by the acquisition of property to the south and east via
the plat of Business Park 95 5t~ Addition. Consequently, CAMAS (new owners of Bjorklund
Ready Mix site) is requesting that the standard drainage and utility easements on the former
south and east property boundaries be vacated.

On January 12 the City Staff recommended to Council that the easements be vacated provided
that the applicant replace these easements along the new property lines. Jim Lindberg of
Lindberg & McKinnis, P.A., was present representing Camas and Bjorklund and presented the
City Council with a letter signed by the current property owner, Camas, indicating an intent to
replace the vacated easements along the new property lines.

Notification:

In accordance with State Statute, persons owning property within 350 feet of the subject property
were notified of the January 5 public hearing to consider vacating the easements.

Observations:

On January 12, 1999, Council introduced the ordinance to vacate the utility easements and
requested a confirmation from the City Engineer that vacating these easements will not have an
adverse affect on the drainage plan for the area generally. The City Engineer has gone on record
as determining that the vacation of these easements will have no impact on the drainage plan for
the area.

The following items are enclosed for your information:

a)
b)
c)
d)
e)

Site location map
Exhibit A (former and present parcel configuration for 6100 Industry Ave.)
Exhibit B (easements to be vacated and acquired on 6100 Industry Ave.)
Statement from City Engineer
Proposed ordinance
