CC Regular Session <br />Date: 04/12/2011 <br />By: Jo Thieling <br />Administrative Services <br />Item #: 5. 11. <br />Information <br />Title: <br />Introduce an Ordinance amending Section City Code Section 30-3 titled Property Conditions constituting a public <br />nuisance AND amending City Code Section 2-332 titled Abatement and relating to the abatement of grass, weeds or <br />noxious growths in excess of eight inches in height. <br />Background: <br />The Police Department in its role in abating public nuisances in the City has determined that the City Code nuisance <br />provision dealing with grass, weeds, etc., height should be amended so as to define a public nuisance as: <br />All grass, weeds, or noxious growths of vegetation upon public or private property exceeding one foot eight (8) <br />inches in height, or whatever height specified in the appropriate zoning district, excluding acceptable prairie <br />restoration plant materials. <br />In an effort to be proactive, the Police Department would like to start the abatement process at the 8 inch height <br />maximum to better address nuisance grass growth. In addition, the Police Department would like to amend the <br />abatement process regarding grass height so that if the City commences the process once in a growing season, the <br />process is streamlined and time frames shortened for each subsequent abatement on the same property.
