17. DEFINITIONS. <br />(a) "Alterations" are defined in Section 3.2. <br />(b) "Drainage Easement" is defined in Section 3.1. <br />(c) "Environmental Laws" are defined in Section 15.1. <br />(d) "Effective Date" is defined in the first paragraph of this Lease. <br />(e) "Extension Term" is defined in Section 1.4. <br />(f) "Event of Default" is defined in Section 11.1, <br />(g) "Fixtures" are defined in Section 14. <br />(h) "Hazardous Substances" are defined in Section 15.1. <br />(i) "Improvements" are defined in Section 3.1. <br />() "Initial Term" is defined in Section 1.3. <br />(k) "Landlord" means the City of Anoka, Minnesota. <br />(1) "Landlord's Default" is defined in Section 11.4. <br />(m) "Lease" means this Ground Lease. <br />(n) "Memorandum of Lease" is defined in Section 1.5. <br />(o) "Operating Expenses" are defined in Section 2.3. <br />(p) "Plans" are defined in Section 3.2. <br />(q) "Platform Agreement" is defined in Section 1,4. <br />(r) "Proceedings" are defined in Section 5.3. <br />(s) "Property" is defined in Section 1.1. <br />(t) "Rent" is defined in Section 22. <br />(u) "Rent Start Date" is defined in Section 2.1. <br />(v) "Taxes" are defined in Section 5.1. <br />(w) "Tenant" means the Metropolitan Council. <br />(x) "Term" is defined in Section 1.4. <br />18. GENERAL PROVISIONS. <br />18.1 Binding Effect. This Lease shall inure to the benefit of and bind the parties hereto <br />and each of their respective heirs, successors, representatives and assigns. <br />18.2 Severability. If any term or provision of this Lease or the application thereof to <br />any person or circumstance shall be invalid or unenforceable, to any extent, the remainder of this <br />Lease, or the application of such term or provision to persons or circumstances other than those <br />as to which it is held invalid or unenforceable, shall not be affected thereby, and each term and <br />provision of this Lease shall be valid and enforceable to the maximum extent permitted by law. <br />18.3 Captions. The captions used in this Lease are inserted as a matter of convenience <br />only, in no way define, limit or describe the scope of this Lease or the intentions of the parties <br />hereto, and shall not in any way affect the interpretation or construction of this Lease. <br />18.4 No Waiver, A waiver by Landlord or Tenant, as the case may be, of any breach <br />of any provision of this Lease shall not be deemed a waiver of any breach of any other provision <br />hereof or of any subsequent breach of the same or any other provision, <br />12 <br />
