CC Regular Session Date: 04/26/2011 By: Jo Thieling Title: Adopt Ordinance Amending Section City Code Section 30-3 titled Property Conditions Constituting a Public Nuisance AND Amending City Code Section 2 -332 titled Abatement and relating to the Abatement of Grass, Weeds or Noxious Growths in Excess of Eight Inches in Height. Background: The Police Department in its role in abating public nuisances in the City has determined that the City Code nuisance provision dealing with grass, weeds, etc., height should be amended so as to define a public nuisance as: All grass, weeds, or noxious growths of vegetation upon public or private property exceeding one foot eight (8) inches in height, or whatever height specified in the appropriate zoning district, excluding acceptable prairie restoration plant materials. In an effort to be proactive, the Police Department would like to start the abatement process at the 8 inch height maximum to better address nuisance grass growth. In addition, the Police Department would like to amend the abatement process regarding grass height so that if the City commences the process once in a growing season, the process is streamlined and time frames shortened for each subsequent abatement on the same property. Attached is a proposed ordinance which if ultimately adopted will address both the grass height recommendation and the streamlined abatement process. This ordinance was introduced on April 12, 2011 and is now available for adoption.
