I have faxed a copy to
City Attorney Goodrich.

The gist of this correspondence is that it is my opinion that the law requiring
conformance of zoning ordinances to comp plans refers to the new plans presently
being considered; not the existing plan.

While this conflicts with the opinion of Kennedy & Graven, the primary purpose of
the Kennedy & Graven opinion dealt with "automatic zoning", and the research
into the area of zoning ordinance compliance with the comp plan my have been
s. lighfly incomplete.

I am sure that City staff would want to do what the law requires, and that having
confficting opinions from different attorneys does not help matters. I would hope
that you would want to have the matter reviewed by your own counsel before acting
on the Arcon re-zoning request.

Bill Dorn

P.
