Board Member Johnson introduced the following resolution and moved for its adoption: <br /> RESOLUTION//03-07-172 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT//0651 RELATING TO A REQUEST <br />FOR A VARIANCE FROM SWIMMING POOL SETBACK REQUIREMENTS FOR <br />PROPERTY LOCATED AT 16300 YOLITE ST. NW. <br /> <br /> WHEREAS, Craig and Deborah Kosnopfal, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 8.21.05 of the Ramsey City <br />Code to allow for a swimming pool to encroach 5 feet into the well setback for the property <br />located at 16300 Yolite St., NW and legally described as follows: <br /> <br />Lot 6, Block 4, Carol-Rose Acres, Anoka County, Minnesota <br />("Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 8.21.05 of the Ramsey City Code on July 10, 2003, and that said public hearing <br />was properly advertised, and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the Subject Property is zoned R-1 Single Family Residential, Rural Developing, and is <br />approximately 1 acre in size. <br /> <br />o <br /> <br />That the Subject Property is surrounded by R-1 Single Family Residential Rural zoning to <br />the west, north, east. To the south, the property is bounded by R-1 Single Family <br />Residential, Rural Reserve. <br /> <br />That an above-ground swimming pool was installed 15 feet from the well, instead of the <br />required 20 feet. <br /> <br />5. That, if granted, the variance will not increase the congestion in the public street. <br /> <br />That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br /> <br />That, if granted, the variance will not diminish established property values within the <br />neighborhood. <br /> <br />That the unique circumstances on the Subject Property do not result from the actions of the <br />Applicant. <br /> <br /> <br />
