Board Member Johnson introduced the following resolution and moved for its adoption: <br /> RESOLUTION//02-11-281 <br /> <br />180SS51 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO BRIAN F <br />JONES AND LAUREL J JONES, (PERMITTEES) FROM THE REQUIRED SETBACKS <br />FROM THE ORDINARY HIGH WATER MARK AND THE COUNTY ROAD IN THE <br />ROGERS LAKE SHORELAND OVERLAY DISTRICT AND DECLARING TERMS OF <br />SAME <br /> WHEREAS, Brian F. Jones and Laurel J. Jones ("Permittees") have properly applied for <br />a variance from Section 9.21.04 of the Ramsey City Code to develop a parcel' and encroach on <br />the required setback from ordinary high water mark and the County Road in the Rogers Lake <br />Shoreland Overlay District on the property generally located on the north side of 179th Lane <br />N.W. (County Road #27), approximately 330 feet east of C.S.A.H. #7, and proposed to be platted <br />and legally described as follows: <br /> <br />Lot 1, Block 1, L.P. Keillor Addition, Anoka County, Minnesota <br /> <br />(Subject Property). <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on November 7, <br />2002, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact #0636, a variance to encroach into the two-hundred (200) foot <br />ordinary high water mark setback and the 50 foot County road setback in the Rogers Lake <br />Shoreland Overlay District is hereby granted. <br /> <br />That the all structures constructed on the Subject Property shall maintain a one-hundred (100) <br />foot setback from the Ordinary High Water (OHW) mark of Rogers Lake and a 40 foot <br />setback from the County Road #27 right-of-way, as dedicated on the proposed plat of L.P. <br />Keillor Addition. <br /> <br />That the Permittees shall obtain all necessary permits prior to commencing any construction. <br />No building permit shall be issued until the Permittee has recorded the plat of L.P. Keillor <br />Addition to create the Subject Property at the offices of Anoka County, signed the variance <br />and reimbursed the City for all costs incurred in processing the variance application. <br /> <br />4. That the property owner shall be responsible for all City costs incurred in administering and <br /> enforcing this variance. <br /> <br /> <br />
