Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #8: Request for Final Plat Review of Tiger Meadows; Case of Monarch Homes <br /> <br />Community Development Director Frolik stated that Monarch Homes has submitted a final plat <br />to develop property located east of Tiger Street and north of Armstrong Blvd. (County Road 83). <br />The preliminary plat approved by the City Council on June 24, 2003 consists of 11 new single - <br />family rural lots and 1 existing homestead. The final plat conforms to the approved preliminary <br />plat. The Final Grading and Construction Plans have been reviewed by the City Engineer and are <br />acceptable subject to comments outlined in the City Staff Review Letter dated July 18, 2003. <br />The Park and Recreation Commission recommended that the developer construct an 8-foot <br />bituminous trail along the north side of Armstrong Blvd. connecting to 167th Avenue, located in <br />Autumn Heights subdivision. At the direction of the City Council during preliminary plat review <br />of Tiger Meadows, Staff and the City Attorney discussed viable options for providing an access <br />to Autumn Heights Park from both Rabbit Street located in Tiger Meadows Subdivision and <br />Nutria Street located in Autumn Heights Subdivision, A sketch referred to as Exhibit A was <br />presented. This sketch provided for a neighborhood connection from Tiger Meadows to Autumn <br />Heights Park and the existing parking lot in Autumn Heights Park, replaces the southerly access <br />to the existing park from Nutria with a northerly access, upgrades the existing parking lot with <br />bituminous pavement and concrete curbing, and provides a second parking lot area that could <br />also be used for a basketball court. The Park and Recreation Commission reviewed Exhibit A <br />and they did not see the benefit of having two parking lots within the park. An additional sketch <br />drawing prepared by City Staff, referred to as Exhibit B, provides for a one-parking lot <br />configuration as discussed by the Park Commission. Staff noted that it is appropriate to utilize <br />park dedication fees for both the neighborhood access connection and parking lot improvements. <br />Staff is estimating that construction and engineering costs to provide for the access and parking <br />lot improvements to Autumn Heights Park will exceed park dedication fees collected from this <br />plat and the overage will be the City's responsibility. <br /> <br />Councilmember Kurak inquired if the legal question about the possibility of placing a road <br />through the park had been addressed. <br /> <br />City Attorney Goodrich explained that when the City accepts park land they accept it as Trustee <br />to use for park purposes or the land would revert back to the people who dedicated the park, <br />which is the reason for showing amenities within the parking lot. <br /> <br />Councihnember Kurak stated that the Park Commission Chair was concerned with setting <br />precedent with using park dedication funds for the construction of a road. <br /> <br />City Attorney Goodrich replied that the City would not be setting legal precedent, but someone <br />could bring the issue forward. <br /> <br />City Council/July 22, 2003 <br /> Page 17 of 33 <br /> <br /> <br />
