He stated again that the way this is worded he would have to get all the vehicles in <br />the building, and he cannot do that. <br /> <br />Chairperson Johnson stated he hopes the plan is to take a significant amount of items in the back <br />yard and put them in the building. He indicated it appears the concern is that he will fill up the <br />building and then fill up the yard again. <br /> <br />Mr. St. Hilaire assured the Commission that would not happen. He stated he has been selling off <br />some already. <br /> <br />Chairperson Johnson asked what assurance can they could give the neighbors that this would <br />help clean up the yard. <br /> <br />Assistant Community Development Director Trudgeon stated the issue raised was with the end of <br />the sentence. He proposed they change the last line of condition 7 to say '...with the exception <br />of parking vehicles and equipment that are stored in accordance with City Code'. <br /> <br />Commissioner Brauer indicated he was still confused. The Code says he can store things outside <br />if they are stored properly, so he questioned why they were trying to tell Mr. St. Hilaire he cannot <br />do that. <br /> <br />Assistant Community Development Director Trudgeon agreed. He stated his wording change to <br />indicate he could store things outside as long as within Code would correct the issue. He <br />indicated Staff has heard from neighbors that outside storage was an issue, so they were trying to <br />make sure that granting this conditional use permit would help mitigate the situation. <br /> <br />Commissioner Brauer asked if the outside storage was currently a problem, or if everything is <br />within code. <br /> <br />Assistant Community Development Director Trudgeon stated currently everything was stored <br />properly, but there has been a history. He indicated Staff certainly wants to see him put up the <br />building. <br /> <br />Commissioner Brauer stated again they could not force him to put specific things in the building. <br />He agrees they need to look at the code, since it is now saying he could put vehicles from one <br />side of his property to the other, but he does not think they should be forcing the issue here. <br /> <br />Assistant Community Development Director Trudgeon stated the code is probably 25 years old. <br /> <br />Motion by Commissioner Brauer, seconded by Commissioner Shepherd to close the public <br />hearing at 7:58 p.m. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Johnson, Commissioners Brauer, Shepherd, <br />and Watson. Voting No: None.
