WHEREAS, the Anoka County PIN's for the various parcels are as follows: 28-32-25-13-0001 28-32-25-13-0005 28-32-25-42-0001 28-32-25-44-0010 28-32-25-41-0001 and WHEREAS, the property owner of the Subject Property has been identified by the City as follows: B.M.A. ASSOCIATES, a Minnesota Partnership NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: In order to carry out the purposes and objectives described above it is necessary to acquire the Subject Property. The acquisition of the following Subject Property by exercise of eminent domain in the manner provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be necessary. The City deems it necessary for the reasons set forth above to proceed without delay under Minn. Stat. §117.042 to pay to the owners or into court a sum of money to serve as compensation to the owners of the Subject Property, which amount shall be equal to Petitioner's approved appraisal of value as determined by the City. That the City Administrator is hereby directed to acquire the Subject Property in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. That if the Subject Property cannot be acquired by direct negotiation, it shall be acquired by eminent domain. That the City Council hereby authorizes acquisition of the Subject Property by eminent domain and to take title and possession of that land prior to filing of an award by the Court Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. That the City Attorney is authorized to file the necessary petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court.
