I b. Administration By State Agencies. <br /> <br /> I 1. For on-site ISTS, of that located adjacent <br /> or <br /> group <br /> systems <br /> on <br /> properties <br /> and under single ownership, the owner or owners shall make application for an <br /> obtain a state dispos,,a,1 system permit from the Minnesota Pollution Control <br />I Agency (the) or group systems are designed to <br /> if <br /> the <br /> on-site <br /> ISTS <br /> of <br /> treat an average design flow greater than 10,000 gallons per day. <br /> <br />I 2. For dwellings including apartments, townhouses, resort units, rental cabins and <br /> condominiums, the sum of the flows from all existing and proposed sources under <br /> single management or ownership will be used to determine the need for a state <br />I disposal system permit. <br /> <br /> 3. ISTS serving establishments or facilities licensed or otherwise regulated by the <br />I State of Minnesota including, but not limited to, campgrounds, resorts, mobile <br /> home p?rks, and eating ~-ad drinking establishments, shall conform to state and <br />i local recuirements. <br /> 4. Any ISTS requiring approval by the State of Minnesota shall also comply with all <br />I local cc .~ e.s and this SECTION. <br /> 5. Plans and specifications must receiv.~ apFropriete sta~e~ ar-.' local approval before <br />I construction is initiated. <br /> e. Administration E./ CKy. The city's building inspection depm~nent (the <br />I "Department") shall regulate ISTS and septagc disposal in the city pursuant to this SECTION. <br /> <br /> 1. The der)artment shall have the following duties and responsibilities: <br />I (a) To review all applications for ISTS; <br /> (b) To issue all permits required by this SECTION; <br />I · - (c) To inspect work in progress and to perform the necessary tests to <br /> determine its conformance with this SECTION; <br /> (d) To investigate complaints regarding ISTS and septage disposal; <br />I (e) To perform compliance inspections; <br /> (f) To issue certificates of compliance or notices or noncompliance <br /> where appropriate; <br />I (g) To issue Stop Work Orders and Notices of Violation, pursuant to <br /> this SECTION; <br /> (h) To take complaints to the City Attorney for violations of this <br />I SECTION; ~ <br /> (i) To maintain prior records for ISTS and septage~iisposal including <br /> site evaluation records, design records including calculations and <br />I summaries for all system component sizings and as-builts; and <br /> (j) To submit annual reports to the MPCA to demonstrate enforcement <br />i of the local ordinance per Chapter 7070.0310 MN RULES. <br /> <br /> <br />
