Reha on January 15, 1999, at 11:00 a.m. at the Ramsey Municipal Center, <br />15153 Nowthen Boulevard, Ramsey, Minnesota. William K. Goodrich, Attorney at Law, <br />Randall, Dehn & Goodrich, 2140 Fourth Avenue North, Anoka, Minnesota 55303, <br />appeared on behalf of the City of Ramsey ("the City"). Licensee, John Richard Nieswaag, <br />President of JNT Enterprises, Inc. and owner of M&L Country Liquors, 5900 167t~ Avenue <br />N.W., Ramsey, Minnesota 55303, appeared on his own behalf without counsel. The <br />record in this matter closed at the conclusion of the hearing on January 15, 1999. <br /> <br /> This Report is a recommendation, not a final decision. The Ramsey City Council <br />will make the final decision after a review of the record. The City Council may adopt, reject <br />or modify the Findings of Fact, Conclusions and Recommendations contained herein. <br />Pursuant to the City of Ramsey Ordinance 98-02 section 12, Subd. 5, appeals of any <br />decision made by the hearing officer shall be filed in the district court for the jurisdiction of <br />the City in which the alleged violation occurred. The parties should contact the City of <br />Ramsey Administrative Offices, 15153 Nowthen Boulevard, Ramsey, Minnesota at (612) <br />427-1410 to ascertain when the City Council will consider this matter and the procedure for <br />filing an appeal. <br /> <br />STATEMENT OF ISSUES <br /> <br /> The issues presented in this matter are whether, an employee of M&L Country <br />Liquors violated the provisions of the City of Ramsey Ordinance #98-02 by selling tobacco <br />products to a minor, and, if so, whether adverse action should be taken against the <br />cigarette sales license held by John Nieswaag, owner of M&L Country Liquors. <br /> <br /> Based on all of the proceedings herein, the Administrative Law Judge makes the <br />following: <br /> <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
