I I I I I I I I I I I I I I I I I I CONSIDER SCHEDULING PUBLIC HEARING TO REVIEW EDA ISSUES B~: William K. Goodrich, City Attorney Background: At the Council's work session on March 15, 1999, several issues relating to the Economic Development Authority ("EDA") were discussed. The apparent direction from the meeting was for staff to place a case on tonight's agenda to consider a public hearing for possible change(s) in the EDA. The EDA was established by Enabling Resolution, Resolution 98-11- 280, a copy is enclosed. The Enabling Resolution was adopted pursuant to the authority of Minn. Stat. § 469.091, et seq. Therefore, State statute governs future modifications to the Enabling Resolution. Before the Enabling Resolution can be modified, a public hearing must be held on the proposed modification(s). The notice of the public hearing must contain the purpose of the hearing. Under the statute, the Enabling Resolution can be modified by any one of the following alternatives: A resolution to dissolve the EDA by rescinding Enabling Resolution 98-11-280. A resolution to further limit the powers granted to the EDA in the Enabling Resolution pursuant to Minn. Stat. §469.092, Subd. 2. This statute is enclosed. A resolution modifying the Enabling Resolution by removing some or all of the limit of powers originally specified in the Enabling Resolution. Because Council has not previously directed the purpose of the public hearing, if a public hearing is to be held, Council needs to now select one of the above alternatives as the purpose of the public hearing. Recommendation: Pursuant to discussion. council Action: MotiOn to schedule a public hearing pursuant to Minn. Stat. §469.093, Subd 1. for the purpose of (alternative 1, 2 or 3 above).
