Goodrich, City Attorney <br /> <br />Background: <br /> <br />At the Council's work session on March 15, 1999, several issues <br />relating to the Economic Development Authority ("EDA") were <br />discussed. The apparent direction from the meeting was for staff <br />to place a case on tonight's agenda to consider a public hearing <br />for possible change(s) in the EDA. <br /> <br />The EDA was established by Enabling Resolution, Resolution 98-11- <br />280, a copy is enclosed. The Enabling Resolution was adopted <br />pursuant to the authority of Minn. Stat. § 469.091, et seq. <br />Therefore, State statute governs future modifications to the <br />Enabling Resolution. Before the Enabling Resolution can be <br />modified, a public hearing must be held on the proposed <br />modification(s). The notice of the public hearing must contain the <br />purpose of the hearing. Under the statute, the Enabling Resolution <br />can be modified by any one of the following alternatives: <br /> <br />A resolution to dissolve the EDA by rescinding Enabling <br />Resolution 98-11-280. <br /> <br />A resolution to further limit the powers granted to the EDA in <br />the Enabling Resolution pursuant to Minn. Stat. §469.092, <br />Subd. 2. This statute is enclosed. <br /> <br />A resolution modifying the Enabling Resolution by removing <br />some or all of the limit of powers originally specified in the <br />Enabling Resolution. <br /> <br />Because Council has not previously directed the purpose of the <br />public hearing, if a public hearing is to be held, Council needs to <br />now select one of the above alternatives as the purpose of the <br />public hearing. <br /> <br />Recommendation: Pursuant to discussion. <br /> <br />council Action: <br /> <br />MotiOn to schedule a public hearing pursuant to Minn.
