Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-03- <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR THE PURPOSE <br />OF BUILDING FIRE STATION #2 <br /> <br /> WHEREAS, to provide adequate fire service to the City ofRamsey, a second fire station <br />has been included in the City's Capital Improvement Plan; and <br /> <br /> WHEREAS, in the 1999 CIP $900,000 was budgeted pertaining to the site acquisition, <br />estimated construction cost, and architectural fees of a new fire station; and <br /> <br /> WHEREAS, a twenty-year intrafund loan, funded from the Landfill Improvement Trust <br />Fund, would finance the project; <br /> <br /> WHEREAS, the City has authority to acquire the real property for the Public <br />Improvement by direct purchase or eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to the filing of an <br />award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and § 117.042; <br />and <br /> <br /> WHEREAS, two real properties fit the needs of a 2nd fire station - the first property is <br />located on the southwest corner of 161st and Armstrong Boulevard and the second is located <br />north of the intersection of 153ra and Armstrong: <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the real property as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it <br />shall be acquired by eminent domain. <br /> <br />3) <br /> <br />That the City Attorney is author/zed to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed for <br />terminated by the City or Court. <br /> <br />4) <br /> <br />The purchase price of said property and construction of the 2nd fire station will be funded <br />from an intra-fund loan from the Landfill Trust Fund in the amount of $900,000 which <br />was adopted in the 1999 Capital Improvement Program. <br /> <br /> <br />
