Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 99-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PER_h~T TO <br />EXCEED THE TOTAL AMOUNT OF ACCESSORY BUILDING SPACE AND THE <br />SINGLE BUILDING SIZE RESTRICTION ON A PARCEL OF LAND <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 99-04-__ adopting <br />Findings of Fact #~ for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY TI-IE CIndY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: , <br /> <br />On , 1999, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Jeffrey Sigler ("Permittee") for an overage in total accessory building space and the <br />single building size restriction on the property generally 'known as 17151 Baugh Street N.W. and <br />legally described as follows: <br /> <br /> That part of the Nor[hwest Quarter of the Northeast Quarter of Section 7, Township 32, <br /> Range 25, lying southwesterly of the Southwesterly Right-of-Way Line of Anoka County <br /> Right-of-Way Plat No. 33 and lying southerly oft. be Southerly Line of the North Half of <br /> said Northwest Quarter of the Northeast Quarter, A noka County, Miunesota; except road; <br /> subject to easement of record. <br /> <br />("Subject Property") _ <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.11.02 oft he Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />That this resolution shall allow for the construction of a 5,100 square foot indoor riding <br />arena (" Structure') on the Subject Property. Said Structure is approved for construction <br />with steel panels, color matched to the home. <br /> <br />The Permittee shall obtain all necessary permits prior to commencing any construction of <br />the Structure. <br /> <br />o <br /> <br />That no commercial or industrial activity of any type shall be permitted in said Structure <br />unless the necessary permits have been obtained from the City of Ramsey. <br /> <br />That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this conditional use permit. <br /> <br />o <br /> <br />That the Permittee herein agrees to remedy a justifiable nuisance complaint resulting <br />from the horse related activities on the property within a 24 hour period.
