Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 99-04- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PER_h~T TO EXCEED THE TOTAL AMOUNT OF ACCESSORY BUILDING SPACE AND THE SINGLE BUILDING SIZE RESTRICTION ON A PARCEL OF LAND WHEREAS, the Ramsey City Council adopted Resolution No. 99-04-__ adopting Findings of Fact #~ for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY TI-IE CIndY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: , On , 1999, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Jeffrey Sigler ("Permittee") for an overage in total accessory building space and the single building size restriction on the property generally 'known as 17151 Baugh Street N.W. and legally described as follows: That part of the Nor[hwest Quarter of the Northeast Quarter of Section 7, Township 32, Range 25, lying southwesterly of the Southwesterly Right-of-Way Line of Anoka County Right-of-Way Plat No. 33 and lying southerly oft. be Southerly Line of the North Half of said Northwest Quarter of the Northeast Quarter, A noka County, Miunesota; except road; subject to easement of record. ("Subject Property") _ This permit is issued pursuant to Section 9.03.04 and 9.11.02 oft he Ramsey City Code. The conditions of this permit are as follows: That this resolution shall allow for the construction of a 5,100 square foot indoor riding arena (" Structure') on the Subject Property. Said Structure is approved for construction with steel panels, color matched to the home. The Permittee shall obtain all necessary permits prior to commencing any construction of the Structure. o That no commercial or industrial activity of any type shall be permitted in said Structure unless the necessary permits have been obtained from the City of Ramsey. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this conditional use permit. o That the Permittee herein agrees to remedy a justifiable nuisance complaint resulting from the horse related activities on the property within a 24 hour period.
