RAO By: Zoning Administrator Sylvia Frolik Background: On March 19, 1999, the City received an application from T.V. Rao at 14359 Waco Street N.W. to regrade and stabilize t_he bluff line along the Rum River on his property. Observatior's: The subject property is located in the Rum River Scenic Overlay District. Mr. Rao had commenced work to stabilize and prevent further erosion of the river bank on his property, unaware tha.~ a conditional use permit is required for' this kind of project in the Overlay District. Upon notification by City Staff of the need for a permit, work stopped and Mr. Rao immediately submitted the necessary applications fees and plan.q. Mr. Rao states that in the last 10 years, he estimates that they have lost at least 8 feet of riverbank due to erosion. Mr. Rao is proposing to regrade the bluffto a workable slope and stabilize it with the use of rip rap and native plants and grasses. The Planning Commission conducted a public hearing on April 6 and there was one letter of support received from an area resident. There were no objections raised to Mr. Rao's request. The Planning Commission inquired as to whether or not Mr. Rao's request is subject to a review by the Army Corps of Engineers. DNR has also received the application' and they solicit reviews from all pertinent jurisdictions.
