Counciknember introduced the following resolution and moved for its adoption: <br /> RESOLUTION #99-04- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />ALTER THE LANDSCAPE OF PROPI}RTY IN THE RUM RIVER SCENIC OVERLAY <br />DISTRICT <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 99-04-__ adopting <br />Findings of Fact # for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On ', 1999, a Conditional Use Permit ("CLIP") was issued by the City. of Ramsey <br />("City") to T.V. Rao ("Permit Holder") for landscape alterations on the property legally described <br />as follows: <br /> <br />Lot 40, Block 6, RIVER'S BEND, Anoka County, Minnesota. <br />("Subject Property:") <br /> <br />Th~s permit is'issued pursuant to Section 9.03.04 and 9.23.10 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />1. This permit shall expire September 30, 1999. <br /> <br />All construction, erosion control and restoration shall be conducted in accordance with the <br />five (5) sheet set of plans labeled Exhibits A through E, submitted by the Applicant in <br />conjunction with the application dated March 19, 1999. <br /> <br />Ali equipment used for the project shall be maintained and operated in such a manner to <br />minlm~?.e noise, dust, and vibrations adversely affecting surrounding properties. Failed <br />equipment and rubbish shall be removed from the work site regularly. <br /> <br />4. The Permit Holder shall implement sediment and erosion control practices in accordance <br /> with the plans submitted and the recommendations of the Department of Natural Resources. <br /> <br />5. Grading operations shall be conducted in such a manner so as not to affect the surface water <br /> drainage outside the boundaries of the Subject Property. <br /> <br />6.
