CASE # <br /> <br />ADOPT ORDINANCE TO VACATE A ROAD EASEMENT IN THE NORTH HALF OF <br />SECTION 27; CASE OF WALTEK, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />There is a road easement dedicated along the north boundary of the Waltek property. During the <br />site plan review process for the expansion of the Waltek facility, it was determined that their <br />facility would not be able to maintain conformance with structure setback requirements if a road <br />was constructed in that easement at some point in the future. <br /> <br />Observations: <br /> <br />There is sufficient land ~ea on the north side of Waltek's north property line to facilitate a <br />roadway and it is also the City's desire to align that future road with 144th Avenue on the east <br />side of Sunfish Lake BL'd. To facilitate this plan would require relocating the righ:--of-way <br />across the northeast com:r of the Waltek site. Waltek has agreed to provide the right-of-way <br />necessary in the northeast comer of the~ site for this realignment of the road easement in <br />exchar~ge for vacating the existing easement along the north boundary of ~.eir property. <br /> <br />On April 13, 1999, the City Council conducted a public h:aring and introduced an ordinance to <br />vacate ti-,c existing easement. Council also requested that the proposed legal description for the <br />new road right-of-way alignment in the northeast comer of the Waltek site be provided and <br />verified prior to final a~opfion of the vacation ordinance. The legal description has been <br />forwarded to the City Engineer and City Attorney for review. They will be prepared to confn'm <br />the accuracy of the legal description at the Council meeting on April 27. The following ite:ns are <br />attached for your information: <br /> <br />a) Site location map <br />b) Site plan showing existing and proposed easements <br />c) Proposed legal description of easement to be provided <br />d) Proposed ordinance <br /> <br />In accordance with the City Charter, the ordinance is now eligible for adoption. <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />sent notice of the April 13 public hearing and the notice was published in the Anoka County <br />Union. <br /> <br />Recommendation: <br /> <br />City staff recommends adoption of the ordinance at this time. <br /> <br /> <br />
