CONCRETE <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On September 10, 1998, Rick Burnham applied for site plan approval for an office/warehouse on <br />Lot 1, Block 1, HY-10 Ramsey 2na Addition. On September 28, 1998, a 6 month moratorium <br />became effective, which included Mr. Bumham's site, that prohibited any application approvals <br />and development during the comprehensive planning process. At the October, 1998 Planning <br />Commission meeting, a recommendation was forwarded to City Council to reject Mr. Bumham's <br />site plan and uphold the moratorium. <br /> <br />At that point, the Comprehensive Plan draft proposed a land use change on the subject site and <br />contained language requiring urban services for commercial/industrial development. At Mr. <br />Bumham's request, the recommendation of the Planning Commission was not presented to City <br />Council until January, 1999. At that meeting, it was reported by City Staff that the draft <br />Comprehensive Plan no longer proposed a land use change for Mr. Burham's site, but that the <br />language establishing a policy of commercial/industrial development with urban services was <br />still in the draft. It was also noted that the moratorium that included Mr. Burnham's site was due <br />to expire at the end of March. The City Council advised Mr. Burnham that he could resubmit his <br />site plan to the Planning Commission and City Council in March for review and approval, <br />provided he recognizes that the City is under no obligation to approve his plan because the <br />moratorium may be extended and the draft Comprehensive Plan still requires urban services for <br />industrial development (subject site is outside of the Metropolitan Urban Service Area). <br /> <br />On February 23, the City Council introduced an ordinance to extend the moratorium ' another 6 <br />months in order to allow sufficient time for the City to complete the Comprehensive Plan process <br />and adopt official controls to implement the new Plan. That moratorium ordinance was adopted <br />and the moratorium is in place until October 5, 1999. The moratorium includes Mr. Bumham's <br />site. <br /> <br />On March 2, the site plan was submitted to the Planning Commission for review and they <br />recommended Council approval of same contingent upon Mr. Burnham obtaining an exception <br />to the moratorium and resolution of the urban services policy. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) City Staff Review Letter dated February 25, 1999 <br />d) Planning Commission meeting minutes dated March 2, 1999 <br />e) Proposed development permit <br /> <br /> <br />
