3. Compliance with City Code. That the recitals above and the provisions of the City <br />Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as <br />amended to date hereof, are incorporated herein by reference. "' <br /> <br />4. Stage I Improvements Required. The DEVELOPER agrees'to construct the required <br />Stage I Improvements (sanitary sewer, municipal water, storm sewer) according to the terms and <br />conditions of the Tax Increment Financing Agreement and in accordance with the plans <br />submitted to the CITY. Said plans shall be in general conformance with the Grading Plan and <br />the Utility Plan prepared by Walsh Bishop Associates, Inc., dated March 16, 1999, Revision Date <br />April 20, 1999. The final construction plan for sanitary sewer, storm sewer, and watermain shall <br />be submitted to the City Engineer for review and approval prior to construction. The <br />DEVELOPER shall also be responsible, at its expense, for installation of gas, telephone, and <br />electric utility improvements. The DEVELOPER shall be responsible for completing the rough <br />grading and providing lot comer stakes prior to the installation of underground utilities. <br /> <br />5. Satisfaction of Sewer and Water Trunk Char~es. The DEVELOPER agrees to pay <br />the standard per acre sanitary sewer and water trunk charges on that part of the Subject Property <br />for which previous trunk payments have not been made. The current standard charge is Two <br />Thousand Eight Hundred Eighty Nine Dollars ($2,889.00) per acre for sewer and Six thousand <br />Four Hundred and Thirty Five Dollars ($6,435.00) per acre for water. The total acreage of the <br />land for which the mink charges are to be collected is 9.6 acres, resulting in a total payment of <br />Eighty Nine Thousand Five Hundred and Ten Dollars ($89,510.00) to satisfy these trunk charges. <br />It is herein agreed that these fees will be paid pursuant to the terms of the Tax Increment <br />Financing Agreement between the CITY and the DEVELOPER. <br /> <br />6. Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />in the amount of Three Thousand 8ix Hundred Fifty Eight Dollars per industrial acre. The <br />amount of Stormwater Management Fee due on the Plat is Sixty Two Thousand Six Hundred <br />Ninety Eight Dollars ($62,698.00) (17.14 acres x $3,658/aere). The Stormwater Management <br />Fee will be used to cover costs incurred to jack under T.H. #10 for storm sewer outlet. It is <br />herein agreed that this fee will be paid pursuant to the terms of the Tax Increment Financing <br />Agreement between the CITY and the DEVELOPER. <br /> <br /> II. <br />BUILDING PERMITS AND CERTIFICATE OF OCCUPANCY <br /> <br />..Re_quirements for Buildin~ Permits.
