Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-05- <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR THE <br />PURPOSE OF BUILDING FIRE STATION #2 <br /> <br /> WHEREAS, to provide adequate fire service to the City of Ramsey, a second fire <br />station has been included in the City's Capital Improvement Plan; and <br /> <br /> WHEREAS, in the 1999 CIP $900,000 was budgeted pertaining to the site <br />acquisition, estimated construction cost, and architectural fees of a new fire station; and <br /> <br /> WHEREAS, a twenty-year intra-fund loan, funded from the Landfill <br />Improvement Trust Fund, would finance the project; and <br /> <br /> WHEREAS, the City has authority to acquire the real property for the Public <br />Improvement by direct purchase or eminent domain pursuant to Minn. Stat. Chapter 117; <br />and <br /> <br /> WHEREAS, the City has the right to acquire real property prior to the filing of an <br />award by the Court appointed commissioners, pursuant to Minn. Stats. §117.01 t and <br />§117.042; and <br /> <br /> WHEREAS, real properties fit the needs of a second fire station. (PIN# <br />will be available at the meeting) <br /> <br />NOW THERFORFfI~ESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, COUNT..X.OF ANOKA, STATE OF MINNESOTA, as follows; <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the real property as <br />described above in accordance with Minnesota Statues. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That is the real property as described above cannot be acquired by direct <br />negotiations, it shall be acquired by eminent domain. <br /> <br />3) <br /> <br />Than the City Attorney is authorized to file the necessary petition therefore, and <br />to prosecute such action to a successful conclusion or until it is abandoned, <br />dismissed, or terminated by the City or Court. <br /> <br />4) <br /> <br />That the purchase price of said property and construction of the 2nd fire station <br />will be funded from an intra-fund loan from the Landfill Trust Fund in the amount <br />of $900,000 which was adopted in the 1999 Capital Improvement Program. <br /> <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I' <br />I <br /> Ii' <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I, <br /> <br /> <br />
