Any day during which the City Hall is normally crpen <br />for the purpose of conducting public business. Holidays del'reed by State law shall not be <br />counted as regular business days. <br /> <br />Section 110. Exceptions to Dermitions. (Note: The courts have held that the following <br />persons do not create the type of nuisances intended to be regulated by thi.~ typo of <br />and are therefore exempt from the above definitions.) For the purpose of the requirements of <br />this ordinance, the terms 'peddler,' "solicitor,' and "transient merchant" sbal! not apply to <br />any person selling or attempting to sell at whole.sale any gooch, wares, products, <br />merchandise, or other personal Nwperty, to a retailer of the item(s) being sold by the <br />wholesaler. The terms also shill not apply to any person who makes inifi~! contacts with <br />other people for the purpose of es~2blishlng or trying to establhh a regular customer delivery <br />route for the delivery of perishable food and dairy products such as baked goods and milk, <br />nor shall they apply to any person malSn§ deliveries of perishable food and dairy products .to <br />the customers on hi.~ or her ~lished regular de, very route. (Note: The following <br />exemptions are added for clarification lmrpo~) In addition, persons conducting the <br />sales commonly known as garage sales, l'L~mm2go sales, or estate sales, as well as those <br />persons participating in an organic,ed multi-person.bazaar or flea market, shah be exempt <br />from the definitions of peddlers, solicitors, and tr'an.~ient merchants, as shali be anyone <br />conducting an auction as a properly licensed auctioneer, Or any officer of the court conducting <br />a court ordered .sale. Exemption from the definitions for the scope of thi.~ ordinance sh~l! not <br />excuse any person from complyin§ with any other applicable sta0~tory provision or local <br />ordinance. <br /> <br />Section 200. Licensing. <br /> <br />Subdivision I County. Licen~ Requ_ ired. No person shall conduct business as a peddler, <br />solicitor, or transient merchant within the city limits without first having obtained the <br />appropriate license from the County as required, by Minnesota Statutes Chapter 329 as <br />amended. <br />(Note: This subdivision is included primarily for notice purposes. Violations of this <br />provision would usually be handled under State law.) <br /> <br />Subdivision 2 City. Licen~ Requ_ ired. Except as otherwise provided for by thl.q ordinance, <br />no person shall conduct business as either a peddler or a transient merchant without first <br />having obtained a license from the city. (Note: Due to caselaw, solicitors should not be <br />licensed; see the registration requirement under section 300 of this ordinance.) <br /> <br />Subdivision 3 A_t~_ lie~tion. Application for a city license to conduct business as a peddler or <br />transient merchant shall be made at least fourteen (14) regular business days before the <br />applicant desires to begin conducting business. Application for a license shall be made on a <br />form approved by the city council and available from the office of the city clerk. All <br />applications shall be signed by the applicant.
