Background: <br /> <br /> CASE #: / O <br /> MINNESOTA MA GIC MID WA Y INC. <br />By: Joyce Pruitt Hottinger, Administrative Services Manager <br /> <br />An application to conduct a carnival on May 21 and May 31 was received on May 17, 1999. The <br />applicant, Minnesota Magic Midway Inc., has requested to use parcels of land located off of <br />Highway 47, north of 142"d Avenue. The land, indicated on the map attachment, is owned by <br />R.F. Development, LLC in Elk River. Chief Manager, Richard Foster, is not authorizing any <br />land owned by R.F. Development for operation of a carnival. <br /> <br />Thus, without the permission of the landowner, the carnival cannot operate at the requested sites. <br />It would be appropriate for Council to deny the request based on the fact that the application is <br />not complete, because no authorization to operate on the requested private land was obtained. <br />Following Council denial of the request, the application fee (which to date, because of the <br />incomplete application, has not been deposited) will be returned to the applicant. <br /> <br />Staff Recommendation: <br /> <br />Deny the carnival application request by Minnesota Magic Midway Inc., based on the letter dated <br />May 18, 1999, by R.F. Development denying authorization to use their private property for <br />operation of a carnival. <br /> <br />Council Action: <br /> <br />Motion to deny the carnival application request by Minnesota Magic Midway Inc., based on the <br />attached letter May 18, 1999, by R.F.
