INTRODUCE ORDINANCE TO ADD SECTION 7.14 "CARNIVALS" <br /> TO CHAPTER 7 OF THE CITY CODE <br /> By: Joyce Pruitt Hottinger, Administrative Services Manager <br /> <br />Background: <br /> <br />The City of Ramsey does not currently regulate carnivals. To date, the City only verifies the <br />carnival has obtained authorization to operate on the land. In order to provide protection of the <br />public's health, safety and welfare, a draft ordinance regulating carnivals was presented for <br />review in the May 18, 1999 Council Work Session. <br /> <br />The draft ordinance is based on examples from the cities of Maple Grove, Blaine, Andover and <br />Anoka. Highlights of the proposed ordinance include: <br /> )} Allowance of exceptions to carnival licensing for fraternal, religious, veterans or <br /> educational organizations (schools) within Ramsey, for carnivals held at the <br /> organization's principal meeting place, or it's school to raise funds for the association. <br /> ~' Requirements for ride inspections in accordance with State Statute. An insurer must <br /> inspect an amusement ride at least once annually. <br /> )' Provision that if Council denies an application for the license; the amount paid shall <br /> be refunded less a $25.00 deduction to recover the costs of processing the application. <br /> > Insurance provisions: <br /> > Mirrors State Statute provision which allows amusement operators who have a <br /> rehab and ride maintenance program that includes daily ride inspections with full- <br /> time permanent maintenance staff, to only carry $50,000 in liability insurance. <br /> 3~ The proposed ordinance requires any carnival not subject to the above mentioned <br /> requirements to provide liability coverage in the amount of $500,000.00 <br /> )~ Requires carnival to indemnify, defend and hold harmless the City from any claims, <br /> by signing an indemnification agreement. <br /> ~ Allows Council to establish conditions as is deemed appropriate to provide for <br /> cleaning the premises. <br /> <br />A resolution recommending fees for carnival licensing will be presented to Council at the <br />second/final reading of the ordinance. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends that Council introduce the Ordinance adding Section 7.14 "Carnivals" to <br />Chapter 7 of the City Code. <br /> <br /> <br />
