Goodrich, City Attorney <br />County Ditch System/Storm Sewer Utility Establishment <br />May 21, 1999 <br /> <br />By letter dated September I6, 19911, Attorney Charles L. LeFcv~cre advised you on the City <br />use of the County Ditch System for Storm Water Management. <br /> <br />In Mr. LeFevcre's letter he suggests the following methods to pay for the desired repair: <br /> <br />2. <br />3. <br />4. <br /> <br />General ad valorem taxes. <br />Subwatershed Distriot per authority found in Minn. Stat. § §a, A4.16-444.21. <br />Chapter 429 special assessments. <br />Create a storm sewer utility per the authority of lVfinrl. Stat. ~444.075. <br /> <br />You have asked that I advise of the procedures to establish a storm sewer utility, listed above <br />as one of Mr. LeFevere's suggested alternatives. Minn. Stat. §§444.075 (the "Statute") <br />provides this procedure. The storm sewer utility establishment procedures are as follows: <br /> <br />The Statute grants authority to "any municipality" to establish the utility either <br />by resolution or ordinance. I recommend the formality of adopting an <br />ordinance. <br /> <br />The Statute grants authority to construct waterworks systems, sewer systems <br />and/or storm water systems. <br /> <br />Specifically, with regard to STORM WATER SYSTEMS, the Statute <br />provides: <br /> <br />That the power granted is in addition to all other City authority to <br />construct such facilities. <br /> <br />Any facilities constructed pursuant to the Statute may not be <br />inconsistent with any watershed plan and/or local water management <br />plan adopted by the City. <br /> <br /> <br />
