Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-05- <br /> <br />RESOLUTION GRANTING FINAL PLAT APPROVAL OF METES AND BOUNDS <br />SUBDIVISION IN SECTION 1~ TOWNSHIP 32, RANGE 25 <br /> <br /> WHEREAS, Ronald and Jacqueline Danner, hereafter referred to as "Developer," have <br />properly applied for a metes and bounds subdivision of the following described property located <br />in the City of Ramsey: <br /> <br />All that part of Government Lot 4, Section I, Township 32, Range 25, Anoka County, <br />Minnesota, lying north of Trott Brook nmning through said Government Lot 4; <br />(the "Subject Property") <br /> <br />and <br /> <br /> WHEREAS, Section 9.50.09 of the Ramsey City Code prohibits the division and <br />conveyance of land by metes and bounds description; and <br /> <br /> WHEREAS, Section 9.50.09 of the Ramsey City Code provides for City Council to <br />waive compliance when compliance will create an unnecessary hardship and failure to comply <br />does not interfere with the purposes of Chapter 9.50 (Subdivision); and <br /> <br /> WHEREAS, the absence of direct access to a public road from the Subject Property <br />prevents the Developer from platting the subdivision in accordance with Section 9.50.09 of the <br />City Code; and <br /> <br /> WHEREAS, the Subject PropertY is approximately twenty-seven (27) acres in size and <br />the Developer desires to create a four (4) acre homestead for selling purposes and retain the <br />remaining twenty-three (23) acres for possible future development; and <br /> <br /> WHEREAS, the Subject Property is within the Rum River Scenic Overlay District for <br />which there is a 4 acre minimum lot size and the Rural Transition area for which there is a four <br />(4) units in forty (40) acres density restriction on a pro-rata basis: and <br /> <br /> AND WHEREAS, the proposed subdivision complies with the Rum River Scenic <br />Overlay District standards and the regulations of the R-I Rural Residential District in the Rural <br />Transition area; and <br /> <br /> WHEREAS, the Ramsey Planning Commission met on May 4, 1999, and recommended <br />City Council approval of the proposed subdivision; and <br /> <br /> <br />
