I I CASE # INITIATE EMINENT DOMAIN PROCEEDING TO ACQUIRE PROPERTY AND PROPERTY RIGHTS TO FACILITATE T.H. #47 STP PROJECT By: Steve Jankowski, City Engineer Background: The City is lead agency on the T.H. #47 STP Project and, as such, is required to obtain the fight- of-way and other property fights necessary to facilitate the project. The City has initiated the acquisition and relocation of 13 homesteads along T.H. #47. To date, the City has closed on 9 of the 13 properties and is anticipating closing on the remaining 4 in the next couple of months. In addition to these whole property takings, there are a number of strip takings and certain property fights that need to be obtained. These property rights inclUde drainage and utility easements (DU), temporary construction easements (TE), and right-of-access (RA) acquisitions. Attached is a listing of the properties involved and below is a summary of the various property fights that need to be acquired. Although the construction is not likely to start until spring 2000, the target date for bid opening is still October 1999. In order to meet this date, all properties should be acquired by September 1999. The eminent domain process requires a 90-day period before the governmental unit can receive title. Recommendation: It is staff's recommendation that City Council adopt the attached resolution initiating eminent domain action in order to establish the time of possession for these necessary properties.
