LeFev.cre advised you on the City <br />use of the County Ditch System for Storm Water Management. <br /> <br />In Mr. LcFevcre's letter he suggests the following methods to pay for the desired repair: <br /> <br />2. <br />3. <br />4. <br /> <br />General ad valorem taxes. <br />Subwatershed District per auflao~ found in Minn. Stat.§§~.16444.21. <br />C'~ 429 special assessments. <br />Create a ~.orm sewer ~H!ity per the authority ofl~dlnn. Stat. §a44.075. <br /> <br />You have asked t_h~,t I advise of the procedurcs m establish a s~rm s~er utility, listed above <br />as one of Mr. LeFcverc's suggested alternatives. Minn. Stat. {}{}444.075 (the "Statute") <br />provides this procedure.' The storm svwcr ulility estabfishment procedures are as follows: <br /> <br /> I. The Statutc/pants authority to "any municipality" to establLsh the utility either <br /> by .resolution or ordinance. ! recommend the formality o£ adopting an <br /> <br />The Statute grants authority to constru~ waterworks systems, sewer systems <br />and/oz storm wat~z systems. <br /> <br />Specifically, with regard to STORM WATER SYSTEMS, the Statute <br />provides: <br /> <br />That the power granted is in addition to all other City authority to <br />construct such facilities. <br /> <br />Any facilities cons~ pursuant to the Statme may not be <br />ineomistent with any watershed plan and/or local water mauagemeat <br />plan adopted by thc City. <br /> <br /> <br />
