require restoration of the slope and top of bluff with native vegetation to mitigate the visual
impact of work performed and protect the natural and scenic value of the fiver.

The Planning Commission conducted a public hearing on June 1 regarding the request for
environmental permits. Two neighbors spoke in support of the action taken by Mr. Luke and Mr.
Weidenbach to stop riverbank erosion. Tom Sauter of Sauter and Sons, the contractor, and the
applicants also explained that because of the steepness of the bank, the bank kept collapsing as
rip rap was installed. The applicants made a judgement call at that point to slope the bank and
install rip rap above the ordinary high water mark in order to stop the erosion.

Recommendation:

The Planning Commission and City Staff recommend that the permits be approved. The permits
have been drafted to require that the applicants engage the services of a professional landscape
architect to develop a landscape plan with will comply with the restoration requirements in local
ordinances and MNNRA guidelines. The Planning Commission has also recommended that
progress to revegetate the riverbanks not be delayed and that the landscape plan and restoration
completion date be subject to the approval of City Staff. Bruce Bacon, the City's environmental
specialist, has met with the applicants twice and with their landscape consultant once. At a
minimum, there will be a verbal report on June 22 regarding the progress of the development of a
landscape plan. :.

Council Action:

Motion to adopt Resolution #99-06-J~ adopting Findings of Fact~.~relating to the
application from Jim and Kathy Weidenbach for an environmental permit for landscape
alterations in the Mississippi Critical and Wild and Scenic River Overlay Districts.

Motion to approve Mr. Jim Weidenbach's request for an environmental permit for landscape
alterations in the Mississippi Critical and Wild and Scenic River Overlay Districts and adopt
Resolution #99-06-j_[2 declaring terms of same.

Motion to adopt Resolution #99-06-13~ adopting Findings of Fact #.~ relating to the
application from Terry and Jane Luke for an environmental permit for landscape alterations in
the Mississippi Critical and Wild and Scenic River Overlay Districts.

Motion to approve Mr. Terry Luke's request for an environmental permit for landscape
alterations in the Mississippi Critical and Wild and Scenic River Overlay Districts and adopt
Resolution #99-06-~ declaring terms of same.

Review Checklist:

CC: 06/22/99

Community Development Director
Community Development Assistant
City Attorney

I
I
I
I
I
I
I
I
I

I
I
I
I
i
I
I
I
I
