His property is 27 acres in size and he is <br />requesting approval of a metes and bounds subdivision to separate his homestead and 4 acres of <br />land from the remainder of his property. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Proposed subdivision <br />Draft City Council meeting minutes dated June 8, 1999 <br />Proposed findings of fact <br /> <br />Observations: <br /> <br />Mr. Danner desires to sell his home with 4 acres of land and retain the remaining 23 acres for <br />possible furore development. The homestead parcel is subject to the regulations of the Scenic <br />River Overlay District, for which the minimum lot size is 4 acres for riparian lots. The property <br />is also in the Rural Transition area for which there is a 4 units in 40 acre density restriction. The <br />subdivision proposed complies with the 4 in 40 density restriction and the 4 acre minimum lot <br />size. <br /> <br />Mr. Danner's property does not have direct access to a public road and access is currently and <br />would continue to be provided to the existing home by a private easement across the 40 acre <br />parcel between Mr. Danner's property and Erkium Street to the north. Mr. Danner has agreed <br />that if this subdivision is approved, no other building permits would be issued on the subject <br />property unless a public road is constructed to City standards into the property. <br /> <br />On June 8, Council reviewed the history of subject property. In 1983, a variance was granted to <br />a previous owner of the land for one home to be built on the property with no direct public <br />access. This variance stipulated that no further subdivision would be permitted without <br />complying with subdivision regulations, including that provision requiting each buildable parcel <br />to have direct access to a public street. In 1988, Council denied the request by another property <br />owner to divide the property into 3 buildable lots that would continue to be served by the private <br />easement versus a public road. In 1989, Mr. Danner utilized the variance approved in 1983 and <br />built his home on the property. <br /> <br />On June 8, the City Council directed Staff to draft findings of fact relating to Mr. Danner's <br />request. <br /> <br /> <br />
