Mr. Beck stated that he feels that it is hard to believe that they can't work something out with DNR that will be beneficial to all parties involved and suggested leaving the variance as written and that they will work with the DNR on the other issues. : Board Member Johnson stated that the allowance for the pond is not a problem and that he is inclined to allow for selective cutting of the vegetation along the waters edge. Board Member Nixt suggested changing the wording of item//4 and item #9 of the Findings of Fact to read "provides for a minimum of not less than 150 feet from the ordinary high water mark", and recommended substituting the word "minimum" for "recommended" in item #6 and include after the wording "which are considered riparian" (lots 4,5, and 6 are considered riparian). Motion by Board Member Johnson, seconded by Board Member Nixt, to adopt Resolution #99- 05-075 adopting Findings of Fact #0492, amended in the affirmative and as discussed, relating to a request for a variance from North Fork, Inc. Motion Carried. Voting Yes: Chairperson Anderson, Board Members. Johnson, Nixt, Dempsey and Kociscak. Voting No: None. Absent: Board Members Jensen and Wivoda. Motion by Board Member Johnson, seconded by Board Member Nixt, to approve North Fork, Inc.'s request for a variance from Sections 9.21.04 (Shoreland Overlay District Development Standards) and Section 9.50.33 (Streets) of the Ramsey City Code and adopt Resolution #99-05: 076 declaring terms of same. Further discussion: Board Member Nixt suggested adding the wording on item c to read "resulting in a minimum setback of 160 feet", and item d to read "resulting in a minimum setback of 156 feet", and item e to read "resulting in a minimum setback of 161 feet." Board Member Johnson suggested adding an item #3 stating the applicant will work with the DNR on minimizing the DNR impact. Board Members Johnson and Nixt amended the motion to include the wording in items c, d, and e and add an item #3 stating the applicant will work with the DNR on minimizing the DNR impact.
