Voting Yes: Chairperson Anderson, Commissioners Jensen, Kociscak, <br />Dempsey, Johnson, Nixt Voting No: None. <br /> and <br /> Wivoda. <br /> <br />COMMISSION BUSINESS/PUBLIC HEARING <br /> <br />Case #1: Review Amendment to R~quest for a Conditional Use Permit to Exceed Sign <br /> Size and Height Restrictions; Case of Dolphin Real Estate <br /> <br />Zoning Administrator Frolik stated that the commercial and industrial districts, the City Code <br />restricts the ground or freestanding sign size to 100 square feet (200 square feet aggregate surface <br />area). Sign heights are restricted to 25 feet from grade to top of sign. In May, Burger King <br />applied for a conditional use permit for a sign that included a 144 square foot franchise logo and <br />a 45 square foot reader board, for a total of 189 square feet. The sign height was proposed to be <br />35 feet. <br /> <br />Zoning explained on 1, 1999, Planning <br /> Administrator <br /> Frolik <br /> that <br /> June <br /> the <br /> Commission <br />conducted a public hearing regarding the original request for an 89 square foot overage in sign <br />size and a ten foot overage in sign height. There were no verbal or written comments submitted. <br />The Planning Commission recommended that the City Council approve the request for a <br />conditional use permit that would limit the business identification portion of the sign to 100 <br />square feet and the reader board to 45 square feet. They also recommended that the sign height <br />be consistent with that of the Holiday Stationstore sign. The Holiday sign permit indicates a <br />height of 23 feet; therefore, it would be recommended that Burger King maintain compliance <br />with the current 25 foot height restriction. <br /> <br />Zoning Administrator Frolik explained that the request and the Planning Commission's <br />recommendations were presented to City Council. At that time, the applicant informed the <br />Council that the Burger King franchise has just released their new sign design which is a 113 <br />square foot circular sign. The applicant then stated that their request was being amended to the <br />113 foot with 45 foot reader that would with the 25 foot <br /> square <br /> logo <br /> sign <br /> square <br /> board, <br /> comply <br />height restriction.
