She explained that the department reorganization would move the City <br />Engineer to the Public Works Department where he would concentrate on strictly engineering <br />duties. A Community Development Director would be hired to supervise and coordinate the <br />activities of the Zoning Administrator, Community Development Assistant, Environmental <br />Specialist and the Inspect:ions staff. The recommendation includes continuation of the contract <br />with Mike Mulrooney for economic development assistance in locating prospective clients. She <br />presented the organization chart, the job description and the comparison of position <br />responsibilities. <br /> <br />Consensus of the Personnel Committee was to approve the job description. <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Beyer to recommend Council <br />authorize staff to advertise to fill the position and that the City continue with the economic <br />development contract. <br /> <br />Motion carried. Voting Yes: Mayor Gamec Councilmember Beyer. Voting No: None. <br /> <br />Case//3: <br /> <br />Consider Proposed Policy Regarding Full-Time City Employees Serving in <br />the Fire Department <br /> <br />Administrative Services Manger Waite smith explained that, to date, the City has no policy if a <br />City employee wants to be a member of the Fire Department. She noted that during the current <br />search for a Public Works Maintenance Worker, a member of the Fire Department applied for the <br />position. Had he accepted the City's offer, we would have had our first regular, full-time <br />employee who is also an on-call fire fighter with our City. Two main issues surfaced in this <br />situation. One is confusion about how the employee will be compensated. Will they be paid <br />regular salary or fire fighter stipend if responding to a fire call during regular work hours? Will <br />they be paid overtime pay for responding to fire calls after regular work hours? The second issue <br />is whether or not employees will be excused from their duties during normal work hours to <br />respond to fire calls. The Fire Chief and Administrative Services Manager are recommending <br />that the City adopt a simple policy that clearly explains how compensation and response time <br />wilI be handled when we have people serving in two capacities. She thought that this situation <br />may likely arise with the addition of a second fire station. Ms. Waite Smith explained that as far <br />as compensation is concerned, that is governed by the federal Fair Labor Standards Act (FLSA). <br />FLSA contains an exemption from overtime requirements for employees who volunteer their <br />time to their employers in a capacity that is different from their normal job. Response to fire <br />calls during regular work/ng hours may differ from department to department and from season to <br />season or day to day in the same department. Therefore, it seems most prudent to allow the head <br />of each department determine when employees may respond to fire calls during work hours. <br /> <br />Fire Chief Kapler noted that the Public Works Department and the Fire Department channel are <br />the same on the radio. <br /> <br />Motion by Mayor Garnet and seconded by Councilmember Beyer to recommend that Council <br />adopt the policy entitled "Employee Participation in Ramsey's Volunteer Fire Department". <br /> <br />Motion carried.
