! <br />! <br /> <br />INSURANCE: <br /> <br />The licensee shall obtain and keep in full force and effect proper 1/ability insurance coverage to protect the City and <br />said licensee against any claims or liability for personal injury or property damage sustained by any persons as a <br />result of the operation of said carnival. <br /> <br />The liability insurance coverage shall name the City as an additional insured, and shall have minimum <br />limits of liability with respect to bodily injury of $100,000 for each person and $300,000 for each <br />occurrence, $50,000 with respect to property damage. <br /> <br />NOTE: Minnesota Statute 184B.02 INSURANCE REQUIREMENTS: "An operator must have an <br />insurance policy in force written by an insurance company authorized to do business in this state, in an <br />amount of not less that $1,000,000 per occurrence, insuring the operator against liability for injury to <br />persons arising out of the use of an amusement ride." <br /> <br />Said licensee shall obtain and keep in full force and effect proper insurance coverage against any persons <br />operating said licensed activities, as required under the provisions of the Workers' Compensation Act of <br />the State of Minnesota. <br /> <br />CERTIFICATES OF INSURANCE EVIDENCING THE ABOVE (LIABILITY AND WORKERS <br />COMPENSATION) MUST BE ATTACHED TO THIS APPLICATION. <br /> <br />OPERATION: <br /> <br />The operator or owner of the Carnival shall comply with the following: <br /> <br />A fire extinguisher must be placed in every cooking facility, near every gas powered ride and in every <br />generator truck. The fire extinguisher must have a tag affixed indicating that it has been inspected on an annual <br />basis. <br /> <br />2. No LP gas is allowed in any of the tents. <br /> <br />3. No intoxicating liquor shall be permitted on the premises of the operation. <br /> <br />4. The Carnival may not operate without receiving a final inspection and approval of the State Electrical <br /> Inspector. <br /> <br />5. Traffic entering and leaving said premises shall be controlled so that there is no interference with the orderly <br /> flow of traffic on the public streets adjacent thereto. <br /> <br />6. The Carnival or portion of the Carnival may not operate if any ride, tent, amusement device, or apparatus <br /> appears to be unsafe or would pose a hazard. <br /> <br />7. A deposit fee of $ l~)00~may be required to guarantee cleaning of the premises. Said deposit to be refunded <br /> upon satisfactory cleanup. <br /> <br />8. Application must be received by the City 30 days in advance of the event. <br /> <br />All obligations of this application and that of the license agreement shall be met by the new license holder. <br /> <br /> <br />
