It was noted that the only requirement now is that they have to receive permission fi.om <br />the landowner where they plan to hold the carnival. It was suggested that some of this <br />could be controlled through the conditional use permit process. Zoning Administrator <br />Frolik pointed out that the CUP fee is about $1,000. <br /> <br />Attorney Goodrich suggested that the City needs to look at zoning and licensing. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Anderson to <br />table action on the proposed carnival ordinance and bring back another draft at a <br />subsequent meeting. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson <br />and Zimmerman. Voting No: None. <br /> <br />Case #12: Condemnation Resolution for Fire Station Proposal <br /> <br />Fire Chief Kapler stated that at the May 11, 1999, Council meeting, staff was directed to <br />begin negotiations on the property referred to as #9. The property owner had been <br />contacted and staff was told that the property was not for sale - that it will not be <br />available on a voluntary basis. Staff was directed to negotiate in the area of three to 10 <br />acres. Unable to negotiate, staff picked a figure of five acres, which would easily <br />facilitate this project and maybe some expansion and is asking for authorization to <br />acquire property through the condemnation process. <br /> <br />Councilmember Anderson stated she hates to condemn land unless there is no other <br />choice. <br /> <br />Mayor Gamec pointed out that the City did hire a consultant and if that's the best area <br />they came up with, we should do smnething about it. <br /> <br />Chief Kapler stated that in the study by Hoisington Koegler, they identified two parcels <br />as pr/me sites that would give the City the best value for the money and left it up to staff <br />to decide. Staff feels that #9 is better by far. <br /> <br />Councilmember Hendriksen cautioned that the City needs to make sure we acquire <br />enough property and he suggested that maybe staff is being too conservative. <br /> <br />Chief Kapler assured Councilmember Hendriksen that five acres is very adequate for a <br />fire station. <br /> <br />Motion by Councilmember Zimmerman and seconded by Mayor Gamec to adopt <br />Resolution #99-05-097 to authorize acquisition of the parcel known as #9 (PIN 20-32-25- <br />44-0001) for the purposes of constructing a second fire station. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson <br />and Hendriksen.
