I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />INTRODUCE ORDINANCE TO VACATE DRAINAGE AND UTILITY <br />EASEMENT IN A.E.C. ENERGY PARK; CASE OF DIRECT ENCLOSURES <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Direct EncloSures recently received site plan approval from the City to construct their <br />new building on Lot 1, Block 2, A.E.C. Energy Park (6825 Sunwood Drive N.W.). <br />During site plan review, it was noted that the building pad is encumbered with a drainage <br />and utility easement. The purpose of the easement was to protect the wetland as defined <br />on the A.E.C. plat. As a result of the Direct Enclosures permit from the Lower Rum <br />River Water Management Organization, a wetland mitigation replacement plan has been <br />approved on the adjacent parcel to the east. Therefore, the wetland area on the Direct <br />Enclosures parcel is being filled for a building pad and the City can release the easement. <br />Since the City owns the adjacent property to the east, north and west, there is no need for <br />the standard drainage and utility easements around the perimeter of the Direct Enclosures <br />lot and they also are proposed to be vacated. <br /> <br />Direct Enclosures is also dedicating a utility easement across the southeast comer of their <br />lot to accommodate the storm sewer. <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 500 feet of the subject property <br />were notified of the August 10, 1999 hearing. <br /> <br />Observations: <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Exhibit of easements to be vacated and dedicated <br />c) Proposed ordinance <br /> <br />Recommendation: <br /> <br />City staff recommends that Council introduce the ordinance to vacate the utility and <br />drainage easement. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #99-XX to vacate certain drainage and utility easements <br />on Lot 1, Block 2, A.E.C.
