His property is 27 acres in size and he is <br />requesting approval of a metes and bounds subdivision to separate his homestead and 4 acres of <br />land from the remainder of his property. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />g) <br />h) <br /> <br />Site location map <br />Proposed subdivision <br />Future subdivision plan <br />Draft City Council meeting minutes dated May 25, 1999 <br />City Council meeting minutes dated June 8, 1999 <br />Draft City Council meeting minutes dated June 22, 1999 <br />Letter from Mr. Danner's attorney <br />Proposed findings of fact <br /> <br />Observations: <br /> <br />Mr. Danner desires to sell his home with 4 acres of land and retain the remaining 23 acres for <br />possible future development. The homestead parcel is subject to the regulations of the Scenic <br />River Overlay District, for which the minimum lot size is 4 acres for riparian lots. The property <br />is also in the Rural Transition area for which there is a 4 units in 40 acre density restriction. The <br />subdivision proposed complies with the 4 in 40 density restriction and the 4 acre minimum lot <br />size. <br /> <br />City Code promotes division of property b~ platting, but also allows for metes and bounds <br />subdivisions where there is a hardship. Mr. Danner's property doe~ not have direct access to a <br />public road and access is currently and would continue to be provided to the home by a private <br />easement across the 40 acre parcel between Mr. Danner's property and Erkium Street to the <br />north. No matter what means is used to split the property, Mr. Danner agrees that no other <br />building permits would be issued on the subject property unless a public road was constructed to <br />City standards into the property. <br /> <br />On May 25, the City Council reviewed the request for a metes and bounds subdivision and tabled <br />any action for additional information regarding: a) the private access easement; b) how the <br />division of property with no public access relates to the procedure used for Pettersen Estates; c) <br />what other subdivisions have been allowed without public access; d) a future development plan <br />coordinated with the property to the north and the northwest. In addition, Staff sought input <br />from Public Works Director/Fire Chief Dean Kapler regarding emergency response concerns on <br />a 2,200 foot private driveway. <br /> <br /> <br />
