ENERGY PARK; CASE OF DIRECT ENCLOSURES <br /> By: Zoning Administrator Sylvia FroIik <br />Background: <br /> <br />During site plan review for the new Direct Enclosures facility in A.E.C. Energy Park, it was <br />noted that the building pad is encumbered with a drainage and utility easement. The purpose of <br />the easement was to protect the wetland as defined on the A.E.C. plat. As a result of the Direct <br />Enclosures permit from the Lower Kum River Water Management Organization, a wetland <br />mitigation replacement plan has been approved on the adjacent parcel to the east. Therefore, the <br />wetland area on the Direct Enclosures parcel is being filled pad and the City can r~lease the <br />easement. Since the City owns the adjacent property to the east, north and west, there is no need <br />for the standard drainage and utility easements around the perimeter of the Direct Enclosures lot <br />and they also are proposed to be vacated. Direct Enclosures is also dedicating a utility easement <br />across the southeast comer of their lot to accommodate the storm sewer. The following items are <br />enclosed for your information: <br /> <br />a) Site location map <br />b) Exhibit of easements to be vacated and dedicated <br />c) Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 500 feet of the subject property were <br />notified of the August 10, 1999 hearing. <br /> <br />Observations: <br /> <br />On August 10, 1999, the City Council conducted a public hearing and introduced an ordinance to <br />vacate the drainage and utility easements on the Direct Enclosures parcel. In accordance with <br />the City Charter, the ordinance is now eligible for adoption. <br /> <br />Recommendation: <br /> <br />City staff recommends adoption of the ordinance at this time. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #99-XX to vacate certain drainage and utility easements on Lot 1, <br />Block 2, A.E.C. Energy Park. <br /> <br />Recording Secretary shall call for a roll call vote as follows: Councilmember Hendriksen, <br />Councilmember Anderson, Councilmember Connolly, Councilmember Zimmerman, <br />Mayor Gamee. <br /> <br />Reviewed by: <br />Community Development Director <br />City Engineer <br /> <br />CC: 08/24/99 <br /> <br /> <br />
