I :1 I I I I I I I I I I I I I I I I PC CASE #: /4 CARNIVAL REGULATIONS By: Joyce Pruitt Hottinger, Administrative Services Manager and Sylvia Frolik, Zoning Administrator Background: City Council tabled action on a proposed carnival ordinance on July 27, in order to provide for an opportunity to address the issue of liquor controls on a carnival site and to clarify the relationship of conditional use permit events to the carnival ordinance. Listed below are the proposed changes to the carnival ordinance: Section 2 License Required The exemption from carnival licensing for fraternal, religious, veteran or educational organizations has been extended to those events which meet the definition of carnival that are regulated by a conditional use permit. Section 6- Licensing The license fee shall be established by Council resolution. The previous draft referenced that language and referenced the fee would be on a daily basis. The elimination of this provides for greater Council discretion in establishing the license fee at a daily or flat rate charge. Section 9- Operation "A" has been rewritten to prohibit alcoholic beverages on the premises of operation without appropriate liquor licensure. This statement was revised based on Council's concern regarding a general provision prohibiting all intoxicating liquor on site. Site Clean Up Fee The site clean up fee was revised to reflect a charge of $500.00 for the first acre or portion thereof and $100.00 for each additional acre or portion thereof. This section was revised to address concerns that adequate funding be available in the event a site is not cleaned up adequately. These and all other monetary obligations associated with the carnival license will be established by a resolution that will accompany the second reading of the proposed ordinance.
