I I I I I I I I I I I I I i I I I I I CASE # INTRODUCE ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENT IN NORTHFORK OAKS 2~n ADDITION; CASE OF RICK AND BARBARA BURNHAM By: Zoning Administrator Sylvia Frolik Background: Rick and Barbara Burnham are in the process of building a new home in Northfork Oaks 2"~ Addition. They own Lots 1 and 2 of Block 1 and desire to center their home on the property. In doing so, the structure will extend over the common property line between the two lots. Notification: In accordance with State Statue, property owners within 350 feet of the subject property were notified of the September 14, 1999 hearing.- Observations: There is a standard 10 foot wide drainage and utility easement on the common property line between the two lots. The City should not issue building permits over drainage and utility easements and a vacation of the easement is necessary. There are no utilities existing in the easement to be vacated. The City Engineer indicates that the vacation of this easement will not impact the drainage plan for the area. The Burnham's did a lot combination at the County, which does not require City approval. The following items are enclosed for your information: a) Site location map b) Exhibit of proposed house location c) Exhibit of easement to be vacated d) Proposed ordinance Recommendation: City staff recommends that Council introduce the ordinance to vacate the utility and drainage easement as requested. CounciI Action: Motion to introduce Ordinance #99-XX to vacate certain drainage and utility easements in Northfork Oaks 2nd Addition.
