I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br /> <br /> CASE # <br /> <br /> INTRODUCE ORDINANCE TO VACATE <br /> DRAINAGE AND UTILITY EASEMENT IN NORTHFORK OAKS 2~n ADDITION; <br /> CASE OF RICK AND BARBARA BURNHAM <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Rick and Barbara Burnham are in the process of building a new home in Northfork Oaks 2"~ <br />Addition. They own Lots 1 and 2 of Block 1 and desire to center their home on the property. In <br />doing so, the structure will extend over the common property line between the two lots. <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />notified of the September 14, 1999 hearing.- <br /> <br />Observations: <br /> <br />There is a standard 10 foot wide drainage and utility easement on the common property line <br />between the two lots. The City should not issue building permits over drainage and utility <br />easements and a vacation of the easement is necessary. There are no utilities existing in the <br />easement to be vacated. The City Engineer indicates that the vacation of this easement will not <br />impact the drainage plan for the area. The Burnham's did a lot combination at the County, <br />which does not require City approval. The following items are enclosed for your information: <br /> <br /> a) Site location map <br /> b) Exhibit of proposed house location <br /> c) Exhibit of easement to be vacated <br /> d) Proposed ordinance <br /> <br />Recommendation: <br /> <br />City staff recommends that Council introduce the ordinance to vacate the utility and drainage <br />easement as requested. <br /> <br />CounciI Action: <br /> <br />Motion to introduce Ordinance #99-XX to vacate certain drainage and utility easements in <br />Northfork Oaks 2nd Addition. <br /> <br />Reviewed by: <br />Community Development Director <br />City Engineer <br /> <br />CC: 09/14/99 <br /> <br /> <br />
