CASE # I <br /> <br /> ADOPT ORDINANCE TO VACATE <br />DRAINAGE AND UTILITY EASEMENT IN NORTItFORK OAKS 2~a) ADDITION; <br />CASE OF RICK AND BARBARA BURNHAM <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Rick and Barbara Burnham are in the process of building a new home in North.fork Oaks 2nd <br />Addition. They own Lots 1 and 2 of Block 1 and desire to center their home on the property. In <br />doing so, the structure will extend over the common property line between the two lots. <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />notified of the September 14, 1999 hearing. <br /> <br />Observations: <br /> <br />On September 14, 1999, the. City Council introduced an ordinance to vacate the drainage and <br />utility easement. In accordance with the City Charter, the ordinance is now eligible for adoption. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Exhibit of proposed house location <br />c) Exhibit of easement to be vacated <br />d) Proposed ordinance <br /> <br />Recommendation: <br /> <br />City staff recommends that Council adopt the ordinance. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #99-XX to vacate certain drainage and utility easements in <br />Northfork Oaks 2nd Addition. <br /> <br />Reviewed by: <br />Community Development Director <br />City Engineer <br /> <br />CC: 09121/99 <br /> <br /> <br />
