PC CASE #: 8 <br /> <br /> CARNIVAL REGULATIONS <br />By: Joyce Pruitt Hottinger, Administrative Services Manager <br />and Sylvia Frolik, Zoning Administrator <br /> <br />Background: <br />A first reading of the attached ordinance was approved by City Council on September 14, 1999. <br />No changes have been made to the ordinance since the first reading. Council did inquire about <br />the impacts of this ordinance on Game Fair, and was advised in the September 17, 1999 Weekly <br />Update, that the Game Fair has a standing conditional use permit. The proposed carnival <br />regulations includes an exemption for events defined as carnivals, which are already regulated by <br />a conditional use permit process, as long as no amusement rides regulated by MN Stat. Chapter <br />184B, will be used at the event. Thus, the proposed ordinance language allows the Game Fair to <br />be exempt from the carnival regulations ordinance. The City retains controls through the <br />conditional use permit process. <br /> <br />This ordinance does not require a public hearing, so the case is for a second reading of the <br />attached ordinance. <br /> <br />Listed below are the changes that were implemented prior to the first reading of the carnival <br />ordinance: <br /> <br />Section 2 License Required <br />The exemption from carnival licensing for fraternal, religious, veteran or educational <br />organizations has been extended to those events which meet the definition of carnival that <br />are regulated by a conditional use permit. <br /> <br />Section 6- Licensing <br />The license fee shall be established by Council resolution. The previous draft referenced <br />that language and referenced the fee would be on a daily basis. The elimination of this <br />provides for greater Council discretion in establishing the license fee at a daily or flat rate <br />charge. <br /> <br />Section 9- Operation <br />"A" has been rewritten to prohibit alcoholic beverages on the premises of operation <br />without appropriate liquor licensure. This statement was revised based on Council's <br />concern regarding a general provision prohibiting all intoxicating liquor on site. <br /> <br />Site Clean Up Fee <br />The site clean up fee was revised to reflect a charge of $500.00 for the first acre or <br />portion thereof and $100.00 for each additional acre or portion thereof. This section was <br />revised to address concerns that adequate funding be available in the event a site is not <br /> <br /> <br />
