Mr. Burnham explained to the Council the circumstances that have delayed the project and the <br />reason they combined the two lots. <br /> <br />Councilmember Connolly stated that she would not usually recommend going against the City <br />Attorney either, but felt it might be appropriate in this situation. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to recommend <br />Staff issue a building permit prior to expiration of the 30-day ordinance publication period <br />contingent upon Mr. Burnham entering into a hold harmless agreement with the City. The hold <br />harmless agreement must be drafted by City Attorney Goodrich at the cost of the applicant and <br />that it ensures that the applicant will assume all liabilities that the City Attorney feels <br />appropriate. <br /> <br />Motion carried. Voting Yes: Councilmembers Hendriksen, Connolly, and Zimmerman. Voting <br />No: Councilmember Anderson. <br /> <br />ADJOURNMENT <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to adjourn the <br />meeting. <br /> <br />Motion can'ied.
