5.09.03 Dog Regulations. Subd. I. Definitions. Boarding shall mean providing for the care, shelt.e.r, or feedin~ of dog(s), not owned by the owner or occupant of the premises where said dog(s) are kept, fgr any.period exceeding 12 contiguous hours. Dangerous Dog shall mean and include: 1. Any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury or to otherwise endanger the safety of human beings or domestic animals; or 2. Any dog which attacks a human being or domestic animal without provocation; or 3. Any dog owned or harbored primarily or in part for the purpose of dog fighting or any dog trained for dog fighting. Dog shall mean any male or female of the canine species. ~ domesticated dog. Dog Owner shall mean the license holder or any other person or persons, firm, association, or corporation owning, keeping or harboring a dog. Any person keeping or harboring a dog for five consecutive days shall, for the purposes of this section, be deemed an owner. Kennel, Commercial is a place where boarding and/or tra{ning is offered to any number of dogs not owned by the owner or occupant of the premises. Such boarding and/or training may also include but is not limited to related uses such as selling, breeding, showing, treating Or groom, i.ng. Pet_shops, veterinary cliniCSr, and pet grooming facilities are considered commercial uses but shall not be defined as commercial kennels. A conditional use permit is required in any district where commercial dog kennels are not specifically identified as a permitted use. Kennel, Private is aplace where a dog owner keeps three .(3) or more dogs over six (6) months of aaeo_n property Occupied by the dog owner for residential purposes and where the keeping of such dogs is incidental to the occupancy, of the .premises, and may .include breeding and selling _of dogs as a hobby. An Administrative Kennel License is required for three (3) d__oj~s and a Conditignal Use Permit is required for four (4) or more dogs. Running at Iarge shall mean any dog which is not either: 1. Effectively contained on private property; or 2. Effectively restrained, by chain or leash, to private property with the consent of the property owner; or 3. Effectively restrained by a chain or leash not to exceed (5 feet in length; or 4. Under the voice control of its owner. Subd. 2. Number of Dogs Permitted.
