CASE # <br /> <br />REQUEST FOR A VARIANCE TO ACCESSORY STRUCTURE SETBACK REQUIREMENTS; <br />CASE OF EUGENE AND MELODY HAWK <br /> By: City Planner, Anita Rasmussen <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line than the <br />principal structure. Eugene Hawk is requesting a variance to construct a garage nearer the front property <br />line than the principal structure at 9468 176th Avenue N.W. The parcel is approximately 7.3 acres in size, <br />and the house is located approximately 271 feet from the nearest point on the right-of-way. Mr. Hawk is <br />proposing to construct a garage, which will be approximately 217 feet from its nearest point of the street <br />right-of-way. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the subject <br />property of the request for a variance. <br /> <br />Observations: <br />The site plan submitted and an on-site inspection reveal that the property is significantly covered by <br />wetlands and mature tree growth prohibit construction of a garage in the side or rear yard. In Staff's <br />opinion, the mature tree growth in the area and the alignment of neighboring homes around the street are <br />such that there should be no adverse impact to the neighbors view of the street by the construction of this <br />proposed garage. There are two accessory garages' currently on the property. One is 12x16 and the other <br />is 8x8. The attached garage located on the principal structure is 24 x 24. The existing garages on the <br />Hawk property and the size of the garage proposed is well within the size restrictions established by City <br />Code for parcels 7.3 acres in size. '~ <br /> <br />Staff Recommendation: <br /> <br />In the opinion of City Staff, the physical features on Mr. H~'_~_pr_qp~_~.r.ju~_fify the granting of a <br />variance. City Staff recommends approval of the variance. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution//00-04- <br />Eugene Hawk's request for a variance. <br /> <br />adopting Findings of Fact # <br /> <br />relating to <br /> <br />-and- <br /> <br />Motion to approve Mr. Hawk's request for a variance to accessory structure setback requirements and <br />adopt Resolution//00-04- __declaring terms of the variance. <br /> <br /> <br />
