Board Member introduced the following resolution and moved for its adoption: RESOLUTION #99-05- RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE FOR AN ACCESSORY BUILDING THAT IS LOCATED CLOSER TO THE FRONT PROPERTY LINE THAN THE PRINCIPAL BUILDING AND ENCROACHES ON THE SIDE YARD SETBACK. WHEREAS, Patrick Gould (Permittee) has properly applied for a variance fi:om Sections 9.11.02 and 9.20.11 of the Ramsey City Code for an accessory building that is located nearer the front property line than the principal structure and encroaches on the comer side yard setback on the property generally known as 9205 Ermine Boulevard N.W. and legally described as follows: That East 233.22 feet of the North 433.01 feet of the Southeast Qumer of the Northwest Quarter of Section 6, Township 32, Range 25, Anoka County, Minnesota as measures along the North and East lines of said Southeast Quarter of the Northwest Quarter (Subject to easement for road purpose over the East 33 feet thereof and over the South 33 feet thereof) ("Subject Property") AND WHEREAS, the Board of Adjustment conducted a public hearing on May 4, 1999, pursuant to Section 9.03.05 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That based on Findings of Fact # , a variance to the front yard and comer side yard setbacks for Garage B, as shown on Exhibit A attached hereto, on the Subject Property is hereby granted. That in the event Garage B is damaged to more than 50% of its fair market value, it is approved for reconstruction or repair in its present location which is approximately 75 feet from the front property line and 14 feet from the east property line on the Subject.Property. 3. That the Permit-tee shall obtain all necessary permits prior to commencing any reconstruction or repair of Garage B in the event it is damaged or destroyed. The motion for the adoption of the foregoing resolution was duly seconded by Board Member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained:
