Board Member introduced the following resolution and moved for its adoption: RESOLUTION #99-06- RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A GARAGE THAT WILL ENCROACH ON THE SIDE YARD SETBACK AND DECLARING TERMS OF SAME WHEREAS, Michael Gobematz and Robin Oobematz (Permittees) have properly applied for a variance from Section 9.20.11 of the Ramsey City Code to construct an accessory structure that will encroach on the side yard setback on the property generally known as 5900 177~ Avenue N.W. and legally described as follows: Lot 2, Block 1, Gobernatz Addition, Anoka County,Minnesota. ("Subject Property") AND VOtEREAS, the Board of Adjustment conducted a public hearing on June 1, 1999, pursuant to Section 9.03.05 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That based on Findings of Fact # , a variance to construct an accessory structure that will encroach on the side yard setback requirement is hereby granted. 2. That the accessory garage constructed on the subject property shall not be located any closer than six (6) feet from the west side property line on the Subject Property. 3. That the Permittees shall obtain all necessary permits prior to commencing any construction of the accessory structure. 4. That the accessory structure shall be used for storage of equipment and vehicles in accordance with City Code and no business activity shall be permitted within said structure, unless it is done in accordance with City Code. 5. That the Permittees and/or property owners shall be responsible for all City costs incurred in administering and enforcing this variance.
