Board Member introduced the following resolution and moved for its adoption: <br /> RESOLUTION #99-06- <br /> <br /> RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A <br /> GARAGE THAT WILL ENCROACH ON THE SIDE YARD SETBACK AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Michael Gobematz and Robin Oobematz (Permittees) have properly <br /> applied for a variance from Section 9.20.11 of the Ramsey City Code to construct an accessory <br /> structure that will encroach on the side yard setback on the property generally known as 5900 <br /> 177~ Avenue N.W. and legally described as follows: <br /> <br /> Lot 2, Block 1, Gobernatz Addition, Anoka County,Minnesota. <br /> <br /> ("Subject Property") <br /> <br /> AND VOtEREAS, the Board of Adjustment conducted a public hearing on June 1, 1999, <br />pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact # , a variance to construct an accessory structure that will <br /> encroach on the side yard setback requirement is hereby granted. <br /> <br />2. That the accessory garage constructed on the subject property shall not be located any closer <br /> than six (6) feet from the west side property line on the Subject Property. <br /> <br />3. That the Permittees shall obtain all necessary permits prior to commencing any construction <br /> of the accessory structure. <br /> <br />4. That the accessory structure shall be used for storage of equipment and vehicles in <br /> accordance with City Code and no business activity shall be permitted within said structure, <br /> unless it is done in accordance with City Code. <br /> <br />5. That the Permittees and/or property owners shall be responsible for all City costs incurred in <br /> administering and enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> ., and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br /> Resolution #99-06- <br /> Page 1 of 3 <br /> <br /> <br />
