CASE # <br /> <br />REQUEST FOR AMENDMENT TO VARIANCE FOR AN ACCESSORY STRUCTURE <br />TO BE LOCATED NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL <br />STRUCTURE; CASE OF TERRENCE AND BETTY BELSCHNER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On April 6, 1999, the Board of Adjustment granted the Belschner's a variance to construct their <br />garage closer to the front property line than their home at 7319 162nd Lane N.W. <br /> <br />Observations: <br /> <br />The exhibit that the Belschner's submitted identified that the garage would be 40 feet fi.om the <br />front property line. This measurement was in error; the measurement was taken from the <br />pavement edge, not the property line. The actual distance from the proposed garage to the front <br />property line is 25 feet. <br /> <br />The following items are enclosed for your information: <br /> <br />a) 'Site location map <br />b) Amended site plan <br />c) Resolution #99-04-056 for Findings of Fact #0488 <br />d) Resolution #99-04-057 declaring terms of variance <br />e) Proposed amended Findings of Fact <br />f) Proposed amended Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />proposed amendment to the variance. <br /> <br />Staff Recommendation: <br /> <br />The proposed garage will be built in the same location proposed in April. However, it is <br />necessary to amend the distances recorded in the Findings and Variance. City Staff recommends <br />rescind!ng the previous resolutions adopting findings of fact and variance, and adopting new <br />resolutions with the correct measurements. <br /> <br />Board Action: <br /> <br />Motion to rescind Resolution #99-04-056 adopting Findings of Fact #0488 and Resolution #99- <br />04-057 delcaring terms of variance for Mr. Belschner at 7319 162nd Avenue N.W. <br /> <br /> <br />
